Bluefish Software Terms of User

PLEASE READ THE FOLLOWING TERMS OF USE CAREFULLY BEFORE CONTINUING. INDICATE YOUR ACCEPTANCE OF THESE TERMS OF USE BY SELECTING THE "I ACCEPT" OPTION BELOW.  IF YOU DO NOT ACCEPT THESE TERMS OF USE, SELECT THE "I DECLINE" OPTION BELOW.

"I understand that my license to and use of the Bluefish Wireless Inc. ("Bluefish") software contained on this device, including all databases, documentation, and all content files viewed by the software (the "Software") is governed by and subject to the Bluefish End User License Agreement, which I may review at any time at http://www.bluefishwireless.com/license"

"THE SOFTWARE AND ITS CONTENT ARE PROVIDED "AS IS", WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND.  BLUEFISH EXPRESSLY DISCLAIMS ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE OR NON-INFRINGEMENT WITH RESPECT TO THE SOFTWARE AND ITS CONTENT."

"UNDER NO CIRCUMSTANCES WILL BLUEFISH BE LIABLE TO ANY OTHER PARTY FOR ANY INCIDENTAL, SPECIAL, INDIRECT, RELIANCE, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST DATA, LOST REVENUE, OR LOST PROFITS ARISING OUT OF OR RELATING TO THE SOFTWARE OR ITS CONTENT.  In no event will the total liability of Bluefish for all damages exceed the license fees paid by you for the Software."

"You shall use the Software only on the computer equipment and Hardware authorized by Bluefish, which includes any handheld device with the Palm OS™ operating system version 3.0 and higher. You agree to use the Software only for your own individual use."

"You agree that only Bluefish shall have the right to alter, maintain, enhance or otherwise modify the Software.  You shall not disassemble, decompile or reverse engineer the Software's computer program."

The material in Bluefish RX (the "Application") could include technical inaccuracies or typographical errors. Bluefish Wireless may make changes or improvements to this application and its documentation at any time.

ANY CONTENT, DOCUMENTATION, SOFTWARE AND OTHER MATERIALS INCORPORATED IN THIS APPLICATION ARE PROVIDED "AS IS" AND WITHOUT WARRANTIES OF ANY KIND EITHER EXPRESSED OR IMPLIED, TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW. BLUEFISH WIRELESS DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE USE OF OR THE RESULT OF THE USE OF THE MATERIAL IN THIS APPLICATION IN TERMS OF THEIR CORRECTNESS, ACCURACY, RELIABILITY, OR OTHERWISE.

NEITHER BLUEFISH WIRELESS NOR ANY OF ITS LICENSORS OR SUPPLIERS SHALL BE LIABLE TO ANY PERSON OR ENTITY FOR ANY LOSS, INJURY OR DAMAGE AS A RESULT OF ANY USE OR MISUSE OF THE APPLICATION OR ANY CONTENT, SERVICE OR INFORMATION AVAILABLE OR NOT AVAILABLE THROUGH IT. IN NO EVENT SHALL BLUEFISH WIRELESS, ITS LICENSORS, ITS SUPPLIERS OR ANY THIRD PARTIES LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, INCIDENTAL AND CONSEQUENTIAL DAMAGES, LOST PROFITS, ANY SPECIAL, EXEMPLARY OR PUNITIVE DAMAGES, DAMAGES RESULTING FROM LOST RECORDS OR DATA, INTERRUPTION, DOWNTIME, INCORRECT LINKAGE, DELAY, INACCURACY OR OTHER NONPERFORMANCE, ANY DAMAGES RELATING TO THE USE OR RELIANCE UPON THE APPLICATION OR THE CONTENT, SERVICES OR OTHER INFORMATION CONTAINED THEREIN OR WITH REGARD TO ANY ERRORS, INACCURACIES, OMISSIONS, DEFECTS, NON-TIMELINESS, SECURITY BREACHES, OR ANY OTHER FAILURE TO PERFORM BY BLUEFISH WIRELESS OR ITS LICENSORS OR SUPPLIERS. APPLICABLE LAW MAY NOT ALLOW CERTAIN LIMITATION OF LIABILITIES, SO ONE OR MORE OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

Intellectual Property
The contents of the Bluefish Rx application (the "Application") including but not limited to all text, graphics, images and certain aspects relating to the functionality of the Application deemed by Bluefish Wireless to be of a proprietary nature (the "Intellectual Property") are protected by copyright, trademark and certain other forms of intellectual property protection and all such Intellectual Property is and shall at all times remain the sole and exclusive property of Bluefish Wireless throughout the world. None of the content or Intellectual Property relating to the Application may be reverse-engineered, disassembled, reproduced, transcribed, stored in a retrieval system, translated into any language including computer language, re-transmitted in any form or by any means (electronic, mechanical, photo reproduction or otherwise), resold or redistributed without the prior written consent of Bluefish Wireless.
